Can I make an adult go to rehab in Ontario, BC or Alberta?
What Canadian law allows when an adult refuses addiction treatment — consent rules in Ontario and BC, Alberta's newer framework — and what works instead.
The honest answer most families dread: in most of Canada, an adult who has capacity cannot be made to accept addiction treatment. What you can do is still a great deal.
Consent is the rule
Ontario’s Health Care Consent Act sets out that treatment requires the informed consent of a capable person. BC’s mental-health law allows involuntary care only under specific criteria that centre on mental disorder and safety, not addiction alone — the province’s rights page explains what those criteria are. Treatment someone is forced into against their will is also, in practice, treatment they leave.
Alberta’s newer framework
Alberta has legislated a compassionate-intervention framework for people whose substance use poses serious danger to themselves or others. What it means for families, what the thresholds are and how it is applied is set out on the province’s own page — read the current version there rather than second-hand summaries, because it is new and specific.
The moves that actually work
CAMH’s guide for families of someone unwilling to seek help is the best short read on this. The approach that has evidence behind it changes the environment and the invitation rather than the person: fewer arguments, clear and consistent boundaries you can keep, positive reinforcement of any step toward help, and your own support so you can hold the line. Ultimatums delivered in anger rarely survive the week.
When it is an emergency
Overdose, unconsciousness, a medical crisis, or an immediate risk to life: 911, every time. That is not “making them go to rehab” — it is keeping them alive for the day they say yes.
